S. Department of Agriculture announced Thursday.

C. Escapee to Be Returned HELENA, Mont. (UPI) tana Gov. Babco*ck said Thursday he will return convicted Ray Bailey to the South Carolina prison from which Bailey escaped in 1957. Babco*ck said he made his decision only after being assured Bailey will receive "just consideration" in South Carolina.

The Governor told newsmen he had telephoned Gov. Donald Russell of South Carolina "to get some additional background on the case." Although he indicated sympathy for the 54-year-old Bailey, Babco*ck said his decision to sign the extradition papers was made on the basis that Bailey was wanted for escape. Babco*ck said he felt legally bound not to go any deeper into the case than to ascertain that Bailey was a fugitive from prison. That was readily admitted at an extradition hearing Wednesday at which Bailey was represented by Thomas Wofford, a former U. S.

Senator from South Carolina and now a Greenville, S. lawyer. Wofford, who was the deputy prosecutor at Greenville when Bailey received a life sentence for the 1932 slaying of Greenville policeman A. B. Hunt, urged Babco*ck to grant Bailey sanctuary in Montana on ground his client was a "fugitive from injustice." Wofford claimed Bailey pleaded guilty in 1936 and agreed to a life sentence on the basis of a written agreement that Bailey would serve no longer than 10 years.

Wofford claimed the agreement was not honored by the South Carolina parole board and Bailey spent 21 years behind bars before his escape. He was arrested last month at West Yellowstone where he managed a motel. The FBI picked him up after a sheriff recognized him from a wanted poster. Wofford, who was deputy prosecutor at Greenville when Bailey was sentenced in 1936, told the Governor that Bailey is not a fugitive from justice. Instead, he said, "He is a fugitive from injustice." Wofford said Bailey should have been released from prison in 1946 or sooner under an agreement made before Bailey was sentenced to life in prison in 1936.
